How??? he had already shot the guy twice...thus the gun was in his hand we can ASSume..and the guy he shot took it from him...after being shot....
Without knowing what caliber he was shooting we can ASSume all kinds of things that might be totally wrong...like he shot him with a 25 or 380 and was stunned that he did not fall back like in the movies...bleeding and dying...

No such thing as a magic one stop shot like in the movies with any cal if not put in the right spot.

Not to mention, how many people carry concealed in a retention holster...
Personally for civilian use a retention holster is overkill and not needed unless you like to walk around in open crowds pretending to be joe cool policeman showing off your pistol...

The worst part it this whole ordeal sounds like it started cause the guy that ended up dying got his underwear wadded up his crack to much.
