How to make a diesel conversion legal in New York State?

I've been told all you have to do is go to DMV and have it reclassed as a diesel, therfore making it exempt from emissions. I have not tried it but the guy who told me said he has done it with several trucks. 
The other way would be to use a 95 or earlier truck wich I'm sure you know is already exempt from emissions.
