Only if you are a dealer you are not allowed to sell pistols to anyone in another state unless it is through an FFL dealer in your state.
Again, the onus is not on the private seller to determine if a FtoF sale is to someone from out of State.

Wrong answer and if you sell a pistol to anybody else in another state without using a FFL you can end up in the federal prison system.

Ya might want to check out ATF Online - Firearms FAQs but heck, if you want to spend time in the slammer snuggled up to bubba the love bear it's up to you.

A person may sell or transfer a firearm to a licensee in any State. However, a firearm other than a curio or relic may not be transferred interstate to a licensed collector.

(B2) From whom may an unlicensed person acquire a firearm under the GCA?

A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee's premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes.

(B3) May an unlicensed person obtain a firearm from an out-of-State source if the person arranges to obtain the firearm through a licensed dealer in the purchaser’s own State? [Back]

A person not licensed under the GCA and not prohibited from acquiring firearms may purchase a firearm from an out-of-State source and obtain the firearm if an arrangement is made with a licensed dealer in the purchaser's State of residence for the purchaser to obtain the firearm from the dealer.

Exactly. In [18 U.S.C. 922(a)(3) and (5), 922(b)(3), 27 CFR 478.29 and 478.30] it states "A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee's premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes."

It does NOT say anything about the seller. Again....the onus is on the buyer, not the seller. A person in their own state has no obligation to find out if the person is from the seller's state or not. It says that a person may acquire a firearm within the person's own state..

Ive bought a few weapons out of state (I have no choice for some of the ones I wanted) and have never been able get one shipped to me without being sent from a licensed FFL to a licensed FFL dealer here. Ive been told that thats the way its always been.

That is true for any firearm if it is going to be shipped. However if is is a rifle or shotgun you can go to a different state for a face to face sale. You cannot do a face to face sale in another state if it is a handgun.

To re-iterate and as stated earlier, an out of state sale can only apply in person as long as it is not a handgun.

There are many variables, gray areas, etc but for safety's sake, if you're selling to an individual out of state.....use USPS and ship to a FFL.

That way, if something bad happens, you'll be covered on your end.

In state, seems everybody's different these days. Contact your local LE office or local FFL and they can let you know exactly what your area's laws are.

It can get confusing....delibratly so IMHO.
