Back in the early 90's I worked on the Hess oil tankers running back and forth from their refinery in St. Croix to various east coast ports. The dye was added to the fuel oil storage tanks on the tanker as it was loaded. Same diesel, just designated "clean #2" or "off road" based on loading configuration. That dye should come with a "half life" designation similar to nuclear material. If it contacted your skin, it was in there, not on for at least 2 weeks and was cancerous as hell (extremely high benzene count).
I may have or may not have run it in my trucks, but with some of the fines I've seen detailed in other posts - not no mo. I mean if I did it.

The way this economy is going? States are going to start losing massive amounts of revenue and will step up ANY ways to collect $$ they can. May not be a big thing now, but give a little while.
I'm with you guys tho. WAY to big of a risk right now for what little amount of $$ you may save.
You could always make your own BIO and sell some to your buddies to recoup some of your initial cost.

i got a buddy was running red fuel for awhile then stoped and about two months later got stoped in the middle of town in northern mn got his tank dipped with road fuel in and they still could see red from previouse fuel and got fined, in my eyes its really not worth it cuz ya know damn well the time you do decide to run red fuel will be the time you get your tank dipped thats just how it goes
