Default State Inspection Questions (Exhaust)

So I went to get my truck inspected today and the guy told me that I couldn't have stacks and that I couldn't have it straight piped...I needed a muffler. I live in texas and there's no kind of emission test or anything here. My question is, how is it "illegal" to have a stack in your truck if everyone else has them and not getting pulled over by cops getting tickets. Big Rigs have stacks also. For the muffler part technically turbo serves as a muffler. I'm thinking this guy was being a stickler because he said they have several infractions on their license and some pending. They even went to the extent of getting cameras set up to monitor them.

My question is, are stacks really a reason to not inspect a vehicle? I wouldn't mind taking mine off since it was there when i bought it. I just don't want to because i don't really have the money to buy pipe and extend it or the time and also can they just bend the rules to favor them? Because the rule says "j. The tailpipe fails to discharge exhaust from the rear or sides or top of the passenger compartment of the vehicle. " to me that's means a stack is acceptable or am I wrong.

Sounds like he's being a dick because he doesn't like stacks, I personally hate stacks, my old 6.2 ruined that along with my hearing. There ugly but I do like hearing them pass me now and again. But if possible try getting inspected in a bigger town where they will hopefully be more lenient because it's most likely more common. I'm just glad here in Oklahoma I don't have to deal with it
