I Got Hit
 
So im at sonic for lunch with Shan. Im backing out im fully backed out and I put it in drive when I see this jeep liberty backing out I start honking and she hits me her spare tire and rim hit right above my rear tire. Nothing happened to her vehicle but my bed is dented pretty badly and the paint is chipped. Anyone ever been hit in this spot like this? We both have State Farm and my agent asked if I was stopped and I said yes I was about to pull forward. I said wish I had gunned it but he said she would have probably hit the rear of my truck and messed the bumper and taillight up and I might have hit a car hop. My truck is red and gray two tone if they have to paint most of it im going to try and pay the rest and get them to paint it all red. Ill try to get pics of it tonight. My girlfriend is more worried about it than I am lol.

When the lady hit me it felt like someone jumped in the bed of my truck Shan looked over and said did we just get hit. I busted out laughing.

I had a civic some years back and got rear ended. I wanted to put a full spoiler on plus the lower body panel. The insurance company wouldn't let me. I mean geez they had to paint the whole back end anyway.

Pretty strong, I backed into a pole at Dana with one, the tech who worked on it never bled the brakes, and as soon as I realized it it was too late, the pole (one of those steel ones used to keep people from hitting corners and stuff with the forktruck) bent, but the liberty was fine..

She couldn't it was way to packed. And if she had there was a lot of people there who witnessed it happen any of them could get her plate.

My truck is still in the shop from the guy running a red light. It does suck. They should let you do whatever you want. You will just have to pay the difference. That is how I am getting a cowl hood and Denali head lights. I have State Farm and so does the guy that hit me. They have been pretty good about it all. That is why I keep State Farm. They have taken care of me.

I hope it all works out ok for you.

That will all depend on what shop you go to and the quality of the paint job. If you are having the whole thing painted, make sure they fix any dings or small dents while they are at it. You would be amazed at how well they show up with a shiny new paint job.

You can go to Maaco for $299 (terrible quality) and I bet the figure can run up to $5k pretty easily. A former co-worker had their 2nd gen painted about 2 yrs ago (EC LB) and it cost about $3k if I recall correctly. You might also be able to save some money by looking at just bolting on another bed if the damage to yours is going to cost a lot to fix.

If you do the prep-work yourself you can save a ton of money. I did all the prep on my gf's bumper cover and fender when she needed it replaced (got parts from a junkyard, but they were the wrong color). I sanded them, masked them off, primed them, sanded again, cleaned them, and rubbed them down with alcohol (gets rid of static charge) and then had Maaco paint them since I don't have a booth, or a decent gun, or the knowledge of hardeners and whatnot. They turned out nicer than the factory panels after some wetsanding... Good prep jobs are the key to a nice paint job.

Well im starting to get a little worried I talked to the claims dept and they asked do you want your insurance to pay this or theres and I was blown away. I asked the lady if she was kidding I said I was obviously not at fault I was about to drive off. I even honked my horn. I mean come on. I called Sonic and none of the car hops saw it happen. Shan was in the truck. Can they take her word as a witness? The lady called someone when she got out and told the person on the phone she backed into someone.

The claims agent said she would call the other driver and get there account of the story.

Can someone move this to the Bad Lands? If this keeps going like im afraid its going to then it will need to be there.

My boys truck is in the shop today, getting a new fender, door, hood, bumber and grill. He was in the city and a guy pulled out too far on a side street, cars where blocking his view and nailed devin in the left front bumber. He ended up paying the deductable of 300.00 the whole thing cost ICBC 2500.00... doesnt even look bad but it was.
Anyhow I hope she will pay your deductable and nothing comes out of you pocket.
Im glad you laughed, that makes light of the situation.

I was in tim hortens once and seen this car sitting behind this motor home backing up, she just sat there and honked her horn, she had lots of time to get out of the way, but been fresh off the boat with no brain, she never clued in to move...... the camper backed right into her, he moved ahead, got out and yelled at her,,:madd:,,,,,,,,she ended up with a huge dent in her fender, and she drove away.They never exchanged any info at all, he had no damage to his bumber and drove away too, but this time he got the ol lady out to help him back up........some people..:argh:
It was all i could do too keep my mouth shut:mum:

Wow $1000?!?!?! If it is her fault, her insurance policy should cover it, even if you both go through the same insurance. They can easily tell by the location of the damage and the scene of the accident whose fault it was. Go back and take pictures of the Sonic parking lot and mark where she was parked and where you were in the lane. There's no way they can deny that it was her fault then...

I've found that when both people involved have the same insurance company, it is even more of a pain than if they were with two different ones... Either way the same company is going to have to pay and they don't want to...

We just went through a similar thing. My wife got side swiped by some turd. At first he tried to say she was at fault but the cop told him to STFU after he got on scene. (My wife was traveling north on a road and he was at a stopped on a frontage road waiting to turn left. He never even looked at her, just pulled straight out and smacked her.)

We both had SF. SF called the other driver and got him to admit to fault. It took about 3-4 business days for all of this to get worked out. If he wouldn't have admitted it then they were most likely going to go off of the police report. SF wound up paying our deduct and rental car through his policy.

Tell the truth. stick to your guns and be patient. It'll work out. I can't say for sure if your GF will be usable as a witness. It might depend on state law. But my wife and another dude were both backing out of their parking places at the grocery story a few years ago and backed into each other. He had 2 other ppl with him and they counted as witnesses.

sh wasnt one the phone with 911 was she? If she was then they have that conversation recorded.

My husband got rear ended one time and when the cops got there they asked him and then me what happened. So im guessing that they used me as a witness. Ours is a little different though because of our drop hitch it did nothing to the truck so we didnt have to deal with insurance.

Ok here’s the BS. I talked to the claims adjuster he said she’s giving a different story and that we were backing out at the same time. He also says that since my girlfriend is a byes witness and since she is the only witness. Its going to be 50/50 she pays here’s (she had no damage) and I pay mine. Man im mad I called my dad and he was a lot more pissed than me to the point he’s going to get his lawyer after SF. So ill keep you guys informed. I guess……

Last accident I was in, teenage girl hit the back of my Chevy. Had a trailer hitch on so it didn't do any damage to my truck. But her car got a small dent, scratched the paint a little. Hardly noticeable to the busted mirror on the drivers side along with the bigger dent in the trunk area. I made sure and called the law and waited for them to show up. Did the usual and let me go. Some reason I knew that if I didn't, it would come back on me. Hope it all works out.

parking lot next to sonic has an ATM. It just happens to be the bank I work for. Im going tonight to see if that atm can see the spot I hope it does.

I just got off the phone with a lawyer he said it sounds like SF is giving me the run around he said that Shans statement does count it may not be as strong as others but it does count he also said that I should talk to SF tomorrow and tell them I plan on filing suit against them and I should take them to small claims court he said if they don’t pay up and end up getting a lawyer to call him back and we can go after them for up to 3 times the price of the damage + stress and all of that legal stuff people sue for. So im going to cal tomorrow and tell them and ill get estimates. Wish me luck

state farm payed for my truck to get fixed when my lift blocks broke and tko'd my truck from cab back.

good luck, state farm is pretty good. we have many cars on our policy and they treat us great.

Honestly, State Farm is just doing their job. If it was your company, would you pay out before you had done your homework. I would call your agent tomorrow and calmly explain the situation. Yoiur agent is your best help within the company. Until that lady admits fault, they won't do anything. I had 2 witnesses and a police report (the other guy got a ticket too) when he ran the red light and hit me. He would not admit fault (he ran a red light). State Farm got me a rental and began repairs under my policy. As soon as they heard from the witnesses and police a few days later they just transferred it under his policy. Be careful about pissing off too many people so quickly. It will make it much harder to resolve this. If your truck is driveable, just give it a few days. Even if you win against State Farm, that attorney is going to get 40% or more of whatever they win. You won't have enough to do anything to your truck. I have been hit many times. It is frustrating, but you have to have some patience and play the game. Their is a time to play hardball. This is not it. It will backfire.

Well im going to get an estimate tomorrow. I talked to a lawyer for a little bit more and I've decided basically to tell them im filing suit against SF for the fallowing reasons

1 They never even looked at my truck. If the had they could plainly see that i was not at fault
2 They never even questioned or asked for the phone # of the only witness (Shan)
3 Basically calling Shan a liar and the she was not credible. (She is pissed im going to tell them that if this is not settled he will be hearing from her parents or there lawyer and they plan to file suit for slander)
4 The stress of all of this crap
5 They never asked for the form the police said i needed they actually said it was not necessary.

Im so mad right now I don't know what to do I should calm down by tomorrow.
The lawyer said today in the state of AR you can file for up to 3 times the amount of the damage, the stress, for my girls grief and for all the legal fees he said there's an 80% chance that it will settle out of court if it does go to small claims. If they take it there and they get a lawyer to call him. He wil get a lawyer that WILL win.

Oh and my necks starting to hurt.............

The police form won't do you any good yet. You have to file it. If the other party does not file a conflicting report in 10 bus days, yours becomes the official report of what happens. Only then will the ins company care about it.

Ok i think i figured out this morning why they wanted me to pay my claim on my own insurance. Its called subrogation anyone ever heard of it? Basicly if i had paid SF would have taken over the right to collect from the other insurance. in my case in my case we both have SF so who wins SF.

Thanks leadfoot i think ill get that paper and keep it for a few days then turn it in. My grandpaents are going to through there weight in the ring. They said if im not getting anywhere today to call them and they will call there SF guy and say if this doesnt get worked out they will be moving tere insurance to another place. Thats there house, cars, life, the farm oh and the big one there open red dirt pit.

Why cant people just keep there end of the bargin?

Yep, its a hassle. My latest wreck was with another SF insured and I ahve SF. They had 2 diff adjusters and and each adjuster treated the other as an outside insurance company. They said this is the way it is handled to make sure everyone has a fair shake and an adjuster trying for them. I think your case is diff because it was on private property and no police report. Fill out that form and file it ASAP. Whether your family moves insurance or not SF is handling this. File it and be quiet about it. Then the other party won't think they need to file one. In 10 days that becomes the police report. Contact SF and tell them there is an official report on file with the police that was uncontested and they have to take care of it. Is it sneaky? Sure, but that is the way our laws are writting by the politicians, not the ins companies.

They are worse. Honestly, I have State Farm because they have typically taken care of me. Of all the ins companies I have had to deal with from being hit so many times, SF has been one of the best. A few body shops like working with All State, but my experiences have been awful as have my friends who have All State. Unfortunately, Ins companies do whatever they can to save money and none of them are too helpful. I have heard USAA is pretty good, but I have no personal experience with them. Progressive and Geico are the worst. Stay away from them.
