Update on 2008 Ford F350

As my SIG shows I have an 08 Ford F350 - and as some of you know, I've had some issues with it as posted in these two threads...........

https://www.dieselbombers.com/ford-p...uper-duty.html

Been kinda keepin it quiet cause i didnt want to cause any problems for myself.
Went to court yesterday, April 1st (of all days), vs Ford. It was me vs Ford Motor Company in a Lemon Law Dispute. I paid the State of Texas $35 and they took charge of the case and told me what steps to take. Texas dont mess around with that kind of stuff, very aggressive! Been in the works now for about 2 months. Ford has reprogrammed, test drove (over 1000 miles), ran all kinds of tests and had it in their possession for 3 of the last 6 months. I got it back the last time and drove 1 tank of diesel thru it and parked it. It has sat since then. Anyhow, i get the papers that we are to go to court on the first. I took my wife, because she drove it more the last 2000 miles than i did. And i took my father-in-law cause he was a Ford mechanic and has been a mechanic for 40 years, as a witness. We had about 30 trees worth of paperwork (wanted to be fully prepared).
We went in and told nothing but the truth, i had no reason to lie. Took my side about 45 mins to tell the whole story.
Then the Ford Rep got up there, very sad! First thing she asked was about the farm tags on the truck and why i have them if im a salesman for a concrete pumping company. Told her i got them after i quit drivin it (cheaper while it was sitting) and that i had got a company truck. So then i see all her paperwork - it has all kind of sticky notes on it that says 'Read This'. She said she had never done this before. Her statements did not match the paperwork that we give the judge. He was reading EVERYTHING anybody gave him, fully. He was askin about codes, whats pcm and the such, and she couldnt answer him confidently. He even frowned at her a couple times. I almost felt a little bit sorry for her til i remembered why i was there!
Anyhow, bout an hour and fifteen mins after court started it was over, that included introductions and closing statements (remember, mine took 45 mins).
The judge said the law allows up to 60 days to make his decision, but he said he would be alot faster than that.
Tryin not to get my hopes up to much but it looked real good in there to me. If, for some reason, he decides i have to keep the truck, i WILL be doing the works to this truck, all emissions will be removed. I will not be concerned with warranty because since Nov 07 the warranty aint done me any good anyhow.
Will let y'all know the outcome as soon as i know!!

6.4 problems

I have a 2008 f350 6.4 with 76000 miles on it. I had no problems until 8 weeks ago and then the problems began. Running down the road about 75 miles an hour and all of the sudden it loses power and drops to 30 mph. It has been in the shop for the last 8 weeks with a few days here and there back in my possesion. It has had the radiator, exhaust sensors, high pressure fuel pump, Hepa particulate filter, and all ford updates done to it. It has completely shut down and had to be towed once. Ford doesn't have a clue what to do.
Any thoughts????

dieselmadscientist 04-14-2009 11:52 AM

upgrade would be a dodge cummins :rocking: stock even

If I was you I would check with the department of transportation in your state. Texas has a Lemon Law department. We paid them $35 and told them what was up and they took it from there.

T X R E D M A N, Have you heard anything yet :pca1:????

Just got the paperwork from the judge - he says Ford has to buy it back. The whole deal is figured with some kind of equation - purchase price x miles driven and a lot of stuff. What it comes down to is even though I have been making a $967/month payment since Nov 2007, they want me to pay for mileage that I put on it - BS!! Anyhow, I guess the Judge didn't think that was right so he refigured the numbers and is making Ford pay me the FULL purchase price for the truck, after financing and everything - $54,XXX! The day I got the paperwork in the mail Ford called and left a message while I was at work that said they want to get our "refund" to us as soon as possible. We called them that night, after business hours, and left a message. No response. We have called them everyday for the last 3 business days and haven't heard a word. Been a huge runaround with Ford since the day I started having troubles. Tired of it, just want it all over with!

K50 06-02-2009 11:28 AM

That's brutal. I'm glad the judge ordered you a sweet deal. Hopefully those :edit: will follow through now with what they owe you. Once you get that refund you'll be home free. It's amazing that of the big three, Ford has somehow had the least financial problems despite this, and the $200 million lawsuit against Navistar for the 6.0. Funny how that works.

Does that mean your not going to buy the NEW FORD F-350 with the 6.7 DIESEL engine:humm:

That's a negative ghost rider!! :ph:

dieselhorse 06-03-2009 10:45 AM

Glad to hear the judge ruled in your favor. :c: Now, to collect. Hope they keep their work and get it done asap!

txredman 06-14-2009 09:22 AM

Deal is done!! I delivered the truck to the Ford House wednesday and picked up my check - Ford paid the financing company off and wrote me a check for $7063.12 :yeah: - sounds good but it sucks that I've been paying $967 a month since Nov 07 ($20406 counting my $3000 down payment) better than having to pay them anything. They charged me $50 for a rock chip in the windshield :argh: they wanted to charge me for the wear on the tires - I told them they were crazy - guess they were going to try to see if they could squeeze any more $ out of me before it was over. :bat:

Captain Call 06-14-2009 10:29 AM

$50 for a rock chip huh???? Hell I'd say they're lucky you didn't put a rock chip in their forehead!!!!!!!! :w2:

txredman 06-14-2009 01:04 PM

They got all kinds of BS they go thru - got a circle the size of a quarter they use - if it fits in the circle, it costs $50 - they look at EVERYTHING - inside, outside, tires and under the truck - I had to shampoo the carpet because of a couple little spots or they would have charged me $350 for a complete interior detail - it was all BS like that but now it's done and all I have to do now is try to get a refund of the balance on my extended warranty from the finance company (should be around $1500) plus the difference of what was owed and what Ford paid them (around $300)

Can't believe they tried to bleed you for every penny they could ????:booo:

Hummin Cummins 06-14-2009 10:27 PM

The truck should be as is. It's not a lease return.

txredman 06-14-2009 11:06 PM

That's what I thought. The guy at the dealership was looking over the truck VERY close. I didn't buy the truck there - Ford makes the dealer pay for any "repairs" needed on the truck that the dealer doesn't note and collect for - and since I didn't buy it there that would be "out of pocket" for the receiving dealer. I was a little 'short' with him but also told him I understood why he was looking it over so close. The dealer I bought the truck at is 50 miles away and Ford being nice, let me return it at my local dealer. The dealer where I got the truck wouldn't return any phone calls from the dealer that took the truck back :madd: I'm just glad it's over and hope nobody else has to go thru this crap!

I'm glad your nightmare is over, Now you have to decide what truck your going to get ????

dozerboy 06-27-2009 06:34 PM

Thats odd IIRC a guy in TX that sued GM over his over heating Chevy. Got the purchase price plus kept the truck or at least part of the price it was over 30K I know.

Blue Wolf 07-20-2009 07:46 PM

Congrats!!! Starting the process here in Los Angeles on our truck. Will have to check regarding condition of the truck. Took more pictures today since it went back to the shop! Looking forward to the day I can post - Ford bought it back!:madd:

toy4xchris 07-20-2009 08:36 PM
