Is this legal?

So I came into work and there was a blank DOT inspection form on my toolbox with a truck # on it and a sticky note saying: Ian, please fill out and sign. I did not do a DOT inspection on this truck and when I looked up the R.O. in the computer someone had put my # in for the DOT inspection and when I looked at the truck in the yard it had a new DOT sticker on it. When I informed my boss of the situtation he blew it off saying not to worry about it and it wasnt a big deal. I take falseifacation of things like that very seriously and now my name and employee # is on company records for performing a DOT inspection I didnt do and there is no DOT inspection form.

if i was you i would pitch a fit because if that truck is any accident caused by something that you supposedly signed off on there could be trouble especially where the dot is concerned and if they get pulled over and inspected and it doesnt pass you could get in trouble for that depending on length of time between your inspection and the one they did and maybe even get your certification pulled:scare2:

He's right,If something happens to that truck, accident, ect. The first thing the police are going to do is look at the maintnance records,Espically the D.O.T inspection form. And they see your name on it,then their going to come after YOU.I am very touchy when i do a d.o.t.inspection on a truck, becuse it's my butt on the line when i sign it off.If your boss won't take your name off of it since you didn't do it.You should go to the next level in managment and explain this to them and get this fixed.

bow2no1 02-04-2010 09:42 AM

yeah, don't let 'em push u around like that. your the one being held responsible not your boss.. there must be some reason they just put the sticker on... sounds fishy... i would go scrape it off

If the boss says it is no big deal, then it should'nt be a big deal to get it in writing from the boss or a waiver or something. If you don't fill it out and don't sign it are you still accountable for the insp.?

bow2no1 02-04-2010 10:29 AM

when i worked for the lumber yard my boss would send me out with my truck over loaded so bad the front end would come off the ground when i hit a bump.
he said it was no big deal...... it's never a big deal until someone gets hurt. then it's my fault for letting it happen

I would look for a new job.

is there any management over him? go to them immediately!

Writing, writing, writing,
detail the situation in a letter and date it, explain why you will not fill out a form for a truck you did not inspect, put the sticker on, or enter in he system. also ask who is using your ID maybe mention identity theft. make some copies and ask him to sign one or something, just make sure the situation is well detailed as to why you think it's not right.
get a picture of the sticker on the truck, and your name in the system, keep the sticky note and blank form.

No big deal huh boss? Then YOU sign it. Myself being a company safety officer for 3 years it works like this:

No paperwork? It NEVER happened.

Have paperwork? Great, then thats all we have to go on. No he said/she said. The paperwork is the law and the ONLY way it happened.

No way I'd put my azz on the line like that. Good luck with it man. Like said above, that's your livelyhood. And if your boss doesn't think enough of you to see where you are coming from? Personally I would start looking, or go up the ladder.

I forgot one important part. Something like this happens? you can always write it all down, then mail it to yourself. Put it up in the safe and DONT open it. Certified mail if you can.

Paranoid? Maybe. Been cleared before using this same technique? AFFIRMATIVE! :)
